As reported in Law360, tomorrow the Seventh Circuit will hear two cases with two crucial questions at play: how claims accrue under the Illinois Biometric Information Privacy Act (BIPA), and whether the Labor Management Relations Act preempts some BIPA lawsuits from workers.
On September 28th, the Illinois Supreme Court will hear arguments on whether the state’s workers’ compensation law blocks workers from bringing claims for statutory damages under BIPA.
The courts’ decisions will impact dozens of pending BIPA cases at the state and federal level, where judges have stayed several cases until the Seventh Circuit and Illinois Supreme Court have answered these questions.
