WSJ Highlights ILR’s Support for Fairness in Class Action Litigation Act

A Wall Street Journal article regarding the Fairness in Class Action Litigation Act (FICALA) notes ILR’s support for the legislation.

ILR highlighted the consumer protection aspects of the legislation, pointing to examples “like a deceptive-advertising class action against Dell Inc., settled in 2011, alleging the computer company created the illusion of savings through false discounts. Of the nearly 400,000 purchases covered by the settlement, less than 3% of eligible class members filed claims totaling around $500,000, while the lawyers pocketed $7 million.”

FICALA would prevent “trial lawyers from using incestuous, litigation-factory arrangements to gin up lawsuits,” said Rep. Bob Goodlatte, the bill’s sponsor, in remarks to the Judiciary Committee last week.
