Rickard: ‘Executive Branch Needs a Lesson in Civics When It Comes to Supplements’

Rickard also has an op-ed in National Law Journal regarding the Federal Trade Commission’s suit against Bayer Corp. for failing to conduct randomized, controlled clinical trials on its dietary supplement, Phillips’ Colon Health.

“The FTC seems to have missed a critical memo: Randomized, controlled clinical trials are not required, anywhere under any federal law, for dietary-supplement claims,” writes Rickard. “They are required for prescription drugs, and Congress specifically stated that the same standards do not apply to dietary supplements. Which means the FTC is suing Bayer for failing to do something not required by law.”
