New York Judge Sets Aside $11 Million Ford Asbestos Verdict
New York Judge Barbara Jaffe set aside an $11 million verdict against Ford Motor Co. on Monday, finding that the plaintiff’s general causation expert failed to establish a link between the plaintiff’s mesothelioma-related death and his exposure to asbestos when working on automotive parts.
“That mesothelioma is caused only by exposure to asbestos does not dispose of the issue of whether a defendant’s product caused the mesothelioma,” the judge explained. The issue is “whether a defendant may be held liable for having caused a plaintiff’s mesothelioma.”
