New York Court May Play Big Role in Talc Litigation This Year

The New York City Asbestos Litigation Court, or NYCAL, may play a big role in upcoming litigation over talcum powder, Legal Newsline reports in Forbes.

According to Legal Newsline, the court is known for “loose rules of evidence” which includes the Frye standard for scientific evidence, a lower standard than Daubert, which is used in federal courts and many other states.

Recent research released by the U.S. Chamber Institute for Legal Reform discusses how NYCAL “has consistently been one of the most active asbestos courts nationally, certainly in dollars, and in some instances in numbers of cases. After years in a steady state, NYCAL is currently in a period of potentially substantial change.”
