Monsanto Seeks SCOTUS Review of $25M Roundup Verdict
Earlier this week, Monsanto asked the U.S. Supreme Court to review an appellate ruling that upheld a $25 million verdict awarded in a bellwether trial over claims that its Roundup weed killer causes cancer, according to a report in Law 360. Monsanto’s petition argues that the Ninth Circuit made mistakes that could affect thousands of other federal suits over the Bayer unit’s Roundup weed killer.
“Together, the Ninth Circuit’s errors mean that a company can be severely punished for marketing a product without a cancer warning when the near-universal scientific and regulatory consensus is that the product does not cause cancer, and the responsible federal agency has forbidden such a warning,” Monsanto said in its petition. “That is not, and should not be, the law.”
