Judge Won’t Toss Silver Indictment But Scolds Bharara for “Media Blitz”

New York federal judge Valerie Caproni on Friday denied a motion by former State Assembly Speaker Sheldon Silver to dismiss corruption charges against him, while taking the opportunity to chastise U.S. Attorney Preet Bharara for leading a “media blitz” subsequent to Silver’s arrest.

“In this case, the U.S. attorney, while castigating politicians in Albany for playing fast and loose with the ethical rules that govern their conduct, strayed so close to the edge of the rules governing his own conduct that defendant Sheldon Silver has a non-frivolous argument that he fell over the edge to the defendant’s prejudice,”explained the judge, adding “this case is to be tried in the courtroom and not in the press.”

Notwithstanding, Judge Caproni found no evidence that Bharara’s tactics had improperly influenced the grand jury’s decision to indict Silver.
