As the litigation funding industry continues to grow, it’s time to answer a simple question, says Kevin LaCroix of the D&O Diary: “What are the implications?”

LaCroix says the possibilities that litigation funding can lead to increased litigation “is not merely speculation.” He points to the rise of class action litigation in Australia and Canada as examples of third party funding driving class actions. He says it is very plausible that litigation funding increases class action filings, “even in countries that have not seen it in the past.”

LaCroix notes the calls for regulation of litigation funding, particularly the Institute for Legal Reform’s calls for “transparency through mandatory disclosure of litigation funding.”
