Other Agencies Seem to Be Following DOJ’s Lead: Attorneys with King & Spalding say recent memos from other federal agencies suggest they are following the U.S. Department of Justice’s lead on the force of agency guidance. They say the goal of this policy shift is “to ensure that administrative enforcement actions rely on legally binding authority such as laws and regulations and that enforcement actions are not brought for ‘violations’ of non-binding materials such as guidance or staff views.” (JD Supra)
