Ninth Circuit Decision “Heats Up TCPA Debate”: Last week, the Ninth Circuit ruled that any device with “capacity to dial stored numbers automatically” can be considered an “automatic telephone dialing system” under the Telephone Consumer Protection Act (TCPA). One defense attorney said this ruling “may have just rendered every smartphone user a potential TCPA violator.” (Law360)

West Virginia Chief Justice Says Impeachment Process Must Be Halted: West Virginia Supreme Court Chief Justice Margaret Workman says the impeachment proceedings against her violates the state’s princple of separation of powers and must be stopped. Chief Justice Workman and three other Supreme Court current and former justices are facing impeachment proceedings after state and federal investigations uncovered a series of problematic spending practices.
