The Coca-Cola Co. is urging an Alabama magistrate judge to “rethink his recommendation keeping alive” a proposed TCPA class action suit over alleged unsolicited text messages. The company claims the plaintiff had agreed to the exchange by sending the initial text message. (Law360)

The Washington Supreme Court has found that the state’s “Industrial Insurance Act” prevents the estate of a former Boeing Company worker from suing the aircraft in an asbestos lawsuit, “finding that the plaintiffs hadn’t shown that Boeing knew the injury would certainly occur.” (Law360)
