The plaintiffs in a class action lawsuit over the length of a Subway “footlong” sandwich have decided to drop their case, reports Legal Newsline.

The case drew the ire from both judges and legal experts who questioned the motives of plaintiffs’ counsel. The Seventh Circuit, who rejected a proposed settlement, called the case “utterly worthless.” An opinion piece from the Washington Legal Foundation said it showed the “absurd incentive of class actions.”

ILR research from earlier this year found that food-related litigation has been on the rise in recent years, booming from 20 class actions in 2008 to 170 in 2016.
