Slack Fill Cases Are “Proliferating”: Slack fill suits are brought when a plaintiff lawyer accuses a food or drug company of under-filling packaging, leaving empty slack fill space. These suits are proliferating, and Jenna Green of Litigation Daily writes that she has “zero sympathy for a grown-up who buys a bottle of Advil that clearly says it contains, say, 48 pills, and then sues because it’s not filled to the brim.” (The Am Law Litigation Daily)
