Some of the pending court cases before the U.S. Securities and Exchange Commission (SEC) have been suspended this week due to the challenges against the SEC’s in-house judges. Earlier this month, a federal appeals court in Denver ruled that the appointment of the SEC’s administrative law judges violates the Constitution. This ruling is at odds with a decision from the U.S. Court of Appeals for the District of Columbia Circuit. “At issue is whether administrative law judges are employees or “inferior officers” who wield significant decision-making authority because of their powers to impose fines and bar people from the financial industry.” (Reuters)
