New Study Finds 90% of California Pharmaceutical Plaintiffs are from Other States: A new study released by the Civil Justice Association of California found that ninety percent of the 25,503 plaintiffs in pharmaceutical product liability lawsuits between January 2010 and May 2016 in California are from out of state. The study suggests laws friendly to plaintiffs’ lawsuits and poor standards for courtroom experts make the California legal system a particularly appealing venue for these kinds of cases. (ILR Blog)

7th Circuit Dismisses Class Action Citing Spokeo: Following the 3rd U.S. Circuit Court’s finding last week that Spokeo does not preclude class actions in which plaintiffs allege their injury is intangible, the 7th Circuit has now affirmed the dismissal of a class action claiming that the lead plaintiff “did not plausibly allege that his personal data was at risk as a result of the [defendants] improper retention.” The 7th Circuit ruled that the statute gives only “aggrieved” cable customers the right to sue.
