In a National Law Journal op-ed, U.S. Chamber Institute for Legal Reform President Lisa A. Rickard said the American Law Institute (ALI) has “drifted from its mission to state what the law is and moved toward advocating what certain ALI members think the law should be.”

Since its inception, the ALI has issued “Restatements,” which, according to the group’s website, “address uncertainty” by “restating” the current state of the law. Now, however, Rickard says the restatements “lay out proposed changes to the law that they think would make it better” rather than “stating what the law is.” She points specifically to the recent insurance and consumer contracts restatements, both of which have been the subject of controversy and debate in the American legal community.

Rickard said the influential group must move “back toward its traditional role as an impartial and invaluable authority on the current state of the common law.”
