A New York plaintiff has filed a $5 million lawsuit alleging the labeling of “Ancient Grain Twists” is misleading since the product also includes modern products, Law360 reports.

The term “ancient grains,” the plaintiff says, typically refers to quinoa and chia seeds as opposed to the modern varieties of wheat, corn, rice, and peas. She said she did not know of the large presence of modern ingredients until she looked at the nutrition facts after buying the product.

The plaintiff is seeking treble and punitive damages on behalf of a class that consists of hundreds of thousands of consumers across the country.
