  • ALI Working to Give Plaintiffs’ Bar a ‘New Weapon’?: The American Law Institute (ALI) is “cooking up new common law rules covering consumer contracts that would give courts an unprecedented range of reasons to invalidate or rewrite contract terms.” This move “is unprecedented and blatant in its effort to give the trial lawyers a new weapon to pursue businesses,” said Victor E. Schwartz, chair of public policy practice at Shook, Hardy & Bacon, and long-time ALI member. (Legal Newsline)

  • Attorney Survey Shows Significant ‘Ethical Reservations’ about Third Party Litigation Funding: A survey of 400 attorneys conducted for Above the Law and commercial litigation showed significant reservations about the ethics of litigation funding. “A little less than two-thirds of respondents didn’t have any experience with litigation funding, and more than a quarter of that subset said they would not even consider using it. The biggest reason they cited? ‘Ethical reservations.’” (The Recorder)

  • ILR’s Food Court Paper Highlighted: ILR’s new report, “The Food Court: Trends in Food and Beverage Class Action Litigation” was highlighted by Florida Business Daily. “Florida is among the four states in which three-quarters of all federal food and beverage class actions in the entire country are filed. The state hosted 12 percent of all such suits, surpassed only by California (36 percent) and New York (22 percent). Illinois was home to 7 percent of these cases.” (Florida Business Daily)
