House Judiciary Committee Votes for Sunshine, Justice in Asbestos Litigation: The current asbestos system is plagued by rampant fraud and abuse by plaintiffs’ lawyers; this abuse harms both alleged victims and the economy. Thankfully, Congress is taking action to address this by advancing the Furthering Asbestos Claim Transparency (FACT) Act, which passed out of the House Judiciary Committee yesterday. The bill, among other provisions, aims to shine a light on these trusts so that compensation goes to legitimate victims. (ILR Blog)

Little Clarity on Meaning of Fee-Splitting Ban in Class Actions as it Applies to TPLF: In third party litigation funding (TPLF) some funders, such as Burford, “posits that it can bankroll class action lawyers directly as long as the deals are tailored carefully” other funders feel they cannot fund a class action and comply with the “fee-splitting ban.” These disparate positions demonstrate how the TPLF industry is “navigating ethical rules that were created long before [TPLF].” (Corporate Counsel)

Opposition Mounts to ‘Prejudgment Interest’ Bill in Florida: Opposition is mounting to legislation introduced by Florida state Senator Greg Steube that will require a court to include prejudgment interest in an award from which the plaintiff recovers both economic and non-economic damages. A hearing on the bill will take place on February 21 in the Senate Judiciary Committee. (Florida Business Daily
