In the News Today – December 15, 2017

The landmark Bristol-Myers Squibb case, in which the U.S. Supreme Court limited the scope of personal jurisdiction in multidistrict litigation, may “dramatically limit the location and scope of class litigation,” writes Bloomberg Business.

The story says litigators and defense attorneys are “preparing to go to war over where class suits” can be filed in the wake of that ruling. Defense attorneys are likely to say that the ruling rules out class suits in all states but the defendant’s home state, and plaintiffs’ attorneys will argue that the ruling does not apply to class actions.

The Supreme Court ruled 8-1 that specific jurisdiction was too “relaxed” when California courts allowed nonresidents to join multidistrict litigation proceedings against the pharmaceutical company.
