Flake hearing airs arguments to break up 9th Circuit:  Sen. Jeff Flake (R-AZ) held a hearing late last week on a bill that would split the 9th Circuit and form a new 12th Circuit. Flake said the population under the 9th Circuit has surged from 4 percent of the U.S. to 20 percent. (POLITICO)

7th Circuit Dumps Subway `Footlong’ Settlement; Will Judges Get The Message?: The 7th Circuit rejected a class action against Subway, claiming the sandwich shops’ footlong sandwiches were not actually 12 inches. The court specifically objected to the plaintiffs’ lawyers’ settlement negotiations that would require Subway to measure every sandwich. The court said this settlement, which would have no meaningful benefit to class members, “is no better than a racket.”  (Walden Consultants)
