Ninth Circuit BIPA Ruling Creates “Staggering” Potential Exposure for Companies: Earlier this month, the U.S. Court of Appeals for the Ninth Circuit recently affirmed certification of a class action ruling against Facebook, finding that alleged procedural violations of the Illinois Biometric Information Privacy Act (BIPA) are enough to pose a material risk of harm for purposes of standing. It is the first federal appellate court to make such a ruling. Attorneys at Faegre Baker Daniels believe that this decision may lead to one of the largest consumer class action trials in history, and may add momentum to the ongoing wave of BIPA class actions.
