A New York federal judge ruled that Amarin Pharma Inc. has a “constitutional right to make certain truthful and nonmisleading statements about off-label uses” of omega-3 drug Vascepa, “striking a blow to the U.S. Food and Drug Administration’s restrictions on product marketing.” (Law360)

“We are encouraged that the federal courts are taking a more critical assessment of the federal government’s enforcement activities that have been propelled by overly expansive theories of liability. This is the latest in a series of rulings that show the government has taken its enforcement actions too far,” said ILR President Lisa A. Rickard in response to the U.S. District Court for the Southern District of New York’s preliminary injunction against the FDA. (ILR Statement)

Writing about the proposed employment-related class action against Uber, the Wall Street Journal editorial board writes that, “The plaintiffs lawyers who finance progressive politicians are now assailing Web start ups with class actions the way they do the rest of business.” (Wall Street Journal)
