In a harsh decision, a judge criticized an employment discrimination suit from the EEOC. “In this case the EEOC sued the defendants for using the same type of background check that the EEOC itself uses,” Judge Raymond Kethledge wrote on behalf of a unanimous panel. American Lawyer

The Delaware General Assembly confirmed Andre Bouchard to lead the Delaware Court of Chancery. Bouchard was nominated to take over for former chancellor Leo Strine, who left to become the new chief justice of the state supreme court. Delaware Law Weekly

A federal judge ordered the Department of Labor to pay $565,000 in attorney fees to a company the department accused of wage-and-hour violations. “The DOL failed to act in a reasonable manner both before and during the course of this litigation,” found the judge. National Law Journal
