Federal Judge Rips Plaintiffs Firm, Hands State Farm Win in TX Hailstorm Case

A federal judge handed a win to State Farm Lloyds, issuing a summary judgment against the Mostyn Law Firm in hailstorm litigation the judge found “factually unsupported.”

Following a hailstorm, the plaintiff filed a policy claim with State Farm, who issued payment for the damages. After those damages were allegedly fixed, the plaintiff notified the insurer that the costs were actually a “little higher” because he also decided to upgrade his roof. State Farm issued another check, but the plaintiff sued the company two years later, claiming breach of contract, and seeking up to $1 million in damages.

“The Court notes that this case, like many storm related insurance breach of contract cases filed by the Mostyn Law firm, is factually unsupported,” Judge Micaela Alvarez wrote in her order dismissing the claims with prejudice.
