Do Class Actions Benefit Class Members? “They Don’t,” Says Mayer Brown Attorney

In a Law360 rebuttal to the American Association of Justice’s (AAJ) defense of the class action system, Mayer Brown’s Andrew Pincus said that AAJ’s own study showed that class members do not benefit from class action lawsuits.

Pincus says a number of AAJ’s own data points that show class actions provide little to no benefit to class members. AAJ found that 80 percent of resolved cases provided no benefit (which was 12 percentage points higher than Mayer Brown’s original study). He also pointed to the lack of AAJ data on the low claims rates of class action settlements, which the Consumer Financial Protection Bureau estimated to be about four percent.

Pincus writes: “Empirical data about class actions is important. Logical analysis of that data is just as essential. Mason’s approach unfortunately flunks that test.”
