Controversy Begins to Swirl Around ALI’s Next Restatement

After taking heat for how the recently passed Restatement of the Law of Liability Insurance was written, the American Law Institute (ALI) is now facing similar criticism over its upcoming restatement on consumer contracts, Legal Newsline reports in Forbes.

Critics of ALI’s insurance restatement said it veered off course from its original goal of “restating” the current state of the law and instead suggested what the organization thought the law should be. Shook Hardy & Bacon attorney and ALI member Chris Appel made similar comments about the consumer contract restatement, saying it’s “built not so much on case law, but rather on a blend of statutory law from consumer protection acts – which were never created to address contract law issues.”

ALI’s website says the consumer contract restatement may be discussed at next year’s annual meeting.
