Climate Liability Lawsuits May Soon Target Directors and Officers

Over a decade ago the U.S. Securities and Exchange Commission published interpretive guidance on climate change disclosures; however, the times are changing and the potential liability for directors and officers has never been higher according to an expert analysis that ran on Law 360.

The legal landscape for companies with regards to climate change is developing at a rapid pace, and the plaintiffs bar will soon broaden their lawsuits beyond fossil fuel producers and utilities. As the number of climate lawsuits continues to grow, it is only a matter of time before plaintiffs bring suits against directors and officers.
