Class Action Defense Costs Projected to Rise For Fifth Straight Year

A report published this week by the Carlton Fields law firm found that class action defense costs for companies are projected to increase for the fifth consecutive year.

The firm surveyed nearly 400 companies and found that class action defense costs increased from $2.24 billion in 2017 to $2.46 billion in 2018, and are projected to increase again this year to $2.56 billion. The report attributes the increased costs to the complexity of new issues like data privacy lawsuits, a need to increase in-house staff, and a growing reliance on outside counsel. The report also found that more than one-in-four of the class actions that companies face are “bet-the-company” cases.
