Australian Litigation Funder Expands to Texas as Industry Faces ‘Increased Scrutiny’ from Courts

Australia-based third party litigation funder Bentham IMF is expanding to Texas, and has hired Eric Chenoweth, a commercial and intellectual property litigator at Yetter Coleman, to lead its Houston office.

Last week, Betham IMF and Fortress Investment Group announced a joint deal to “create a fund that could grow up to $200 million to back U.S. litigation,” reports Texas Lawyer’s Ben Hancock, who notes that “litigation funders are under increased scrutiny from the bench.”

“The U.S. District Court for the Northern District of California announced a groundbreaking rule last month requiring the disclosure of funding agreements in class actions, although Bentham doesn’t directly finance class action litigation,” reports Hancock.
