Arkansas Supreme Court Tosses $1.2 B Verdict

The Arkansas Supreme Court overturned a $1.2 billion verdict against Johnson & Johnson on Thursday, the Associated Press reports.

The state sued J&J over the marketing of its antipsychotic drug Risperdal, claiming the company downplayed the risks and marketed it for unapproved uses. In reversing the ruling the court found that the state improperly sued under a law that applies to health care facilities, not pharmaceutical companies.

This is the second Risperdal verdict to be tossed this year. In January, a Louisiana appeals court dismissed a $330 million award after finding the state didn’t present enough evidence in the case.
