6th Circuit Panel Says That MDL Judge’s Ruling in Opioid Case Was ‘Clear Abuse of Discretion’

Yesterday, The U.S. Court of Appeals for the Sixth Circuit said a pretrial ruling by District Judge Dan Polster was a “clear abuse of discretion,” and “was plainly incorrect as a matter of law,” according to a report in Legal Newsline.

The rebuke comes after Judge  Polster allowed two Ohio counties to add so-called dispensing claims to lawsuits against CVS and 11 other pharmacies more than 18 months after the deadline for such changes had passed.
