5th Circuit Delays Hip Implant Bellwether

A hip implant bellwether, which was due to start today, has been postponed by the Fifth Circuit, according to Texas Lawyer.

The three-judge panel said the district judge made a “grave error” in overseeing certain trials with jurisdiction issues. One of the most prominent examples is a scheduled trial in the Texas court on behalf of plaintiffs from New York.

The trial is now scheduled for later this month.
