3rd Circ. Punts Amazon Seller Liability Case To Pa. Supreme Court
The Third Circuit said Pennsylvania’s high court should have a chance to weigh in on state tort law in a case over a woman’s injury from a product she bought on Amazon, according to a report in Law 360. The plaintiff, Heather Oberdorf, is suing Amazon over an allegedly faulty dog collar she purchased from a third-party vendor.
Lawyers for Amazon argued that being a seller requires the transfer of ownership of a product from one party to another, and the Third Circuit noted in its order Tuesday that the company’s position “finds some support in Pennsylvania case law.”
